By providing your email address you consent to receipt of any email regarding this magazine, and other emails which inform you of ACP's other publications, products, services and events and to promote third party goods and services you may be interested in.
This site may contain offers, competitions or surveys which require you to provide information about yourself if you choose to enter or take part in them (Reader Offer). If you provide information about yourself to ACP, ACP will use this information to provide you with the products or services you have requested, and may supply your information to contractors that help ACP to do this. ACP will also use your information to inform you of other ACP publications, products, services and events. ACP may also give your information to organisations that are providing special prizes or offers that are clearly associated with the Reader Offer.

Take 5 Millionaire Hot Seat Promotion terms and conditions
1. Information on how to enter and prizes form part of these terms and conditions. Participation in this promotion is deemed acceptance of these terms and conditions.
2. Entry is open to Australian residents aged 18 years or over only who purchase Take 5 during the promotional period. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter.
3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these terms and conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. Incomplete, indecipherable or illegible entries will be deemed invalid.
4. Only one Take 5 Millionaire Hot Seat game card permitted per specified purchase requirement. Each instant win prize claim must be submitted separately and in accordance with entry requirements.
5. Promotion commences 1/9/10 and all claims for prizes and entries must be received by last mail on 1/10/10.
6. To enter, consumers purchase Take 5 Issues 36 or 37 (on sale 1/9/10 and 8/9/10 respectively) to receive their free Take 5 Millionaire Hot Seat game card. The game card from Take 5 Issue 36 is valid for play each day from 6/9/10 to 10/9/10 inclusive. The game card from Take 5 Issue 37 is valid for play each day from 13/9/10 to 17/9/10 inclusive. Consumers have the chance to win each day during these periods. Consumers are to watch Millionaire Hot Seat on the Nine Network in Australia each weeknight from 6/9/10 to 17/9/10 inclusive. Each weeknight the show will air a special Take 5 Question of the Day segment. When prompted during the segment, consumers are to scratch the panel printed on their game card corresponding to that particular weeknight to reveal their answer. If the answer printed on their game card for that particular night matches the answer revealed during the Take 5 Question of the Day segment, they have won the major prize.
7. To claim their prize, consumers fill in the coupon printed inside their Take 5 Millionaire Hot Seat game card and send it to Take 5 Millionaire Hot Seat Promotion, PO Box 402, Eastern Suburbs MC NSW 2004. If Millionaire Hot Seat is not broadcast in the local area, consumers will be entitled to enter the promotion by filling in the coupon printed inside their Take 5 Millionaire Hot Seat game card and sending it to the address published inside the game card. The Promoter will check if the game card is a winner. If the entrant is not a winner they will be entered into the unclaimed prize draw. Claims must be received by last mail on 1/10/10 and are subject to verification. Consumers are advised to make and keep a clear photocopy of both sides of their winning game card for their records. Winners, if any, will be notified by mail and published in Take 5 Issue 46, on sale 10/11/10.
8. Consumers are also eligible to enter the Bonus Draw. To enter the Bonus Draw, consumers must complete the Bonus Draw coupon printed inside their Take 5 Millionaire Hot Seat game card and send it to Take 5 Millionaire Hot Seat Promotion, PO Box 406, Eastern Suburbs MC NSW 2004. Entries must be received by last mail on 1/10/10. Bonus Draw will take place at 11am AEDST on 29/10/10 at National Products Fulfilment Pty Ltd, 6 Ross Place, Wetherill Park, NSW 2164. Winners will be notified by mail. Winners will also be published in Take 5 Issue 48, on sale 24/11/10. Non-winning entries in the Bonus Draw will also be entered into the unclaimed prize draw.
9. Instant win major prizes include: 10 x Bali Getaways, valued at up to $10,192.88 (depending on date and point of departure). Prize includes two return economy flights from the winner’s nearest capital city to Denpasar international airport valued at up to $3000, five nights accommodation for two people in an Ajana suite at Holiday Inn Resort Baruna Bali including breakfast daily valued at $3638.84, a 90 minute massage for two at the Hotel Spa valued at $339.21, and dinner at Envy restaurant including two cocktails and a three course meal valued at $214.83. Prize also includes $3000 spending money (which will be provided to the winner as a cheque prior to their departure date).
10. Each Bali Getaway prize is subject to availability at the resort’s discretion and is valid for a period of 12 months from the original draw date. Validity date of this prize cannot be extended. The prize winner will be required to provide at least 6 weeks notice of intent to travel. All components of prize are subject to availability at time of booking. Airline and flight times for the flight component of the prize will be at the discretion of the Promoter and flights will be from the winner’s closest capital city that the airline departs from to Denpasar international airport. Transfers are not included. Once booked, any changes made to the booking may incur a cancellation fee or amendment fee, at the cost of the winner. The winner of the prize (and their travel companions) will not accrue any frequent flyer points from taking the prize. All components of the prize must be taken together. Travel Insurance is not included. Travel Prize does not include meals (apart from the specified meals in point 9) or transport to and from departure and arrival points. All other ancillary and travel costs are the winner’s responsibility. All additional costs incurred whereby the prize winner wishes to make variations to the travel are the winner’s responsibility and must be booked separately by the winner. All travel variations are subject to approval by Holiday Inn Baruna Bali upon booking. Travel variations include, but are not limited to extension of travel duration, travellers outside of the age restriction and additional travellers. Prize winners may be required to present credit card at time of accommodation check in.
11. Bonus Draw prize includes 1 x Samsung LCD TV, valued at $1499.
12. Overall total prize pool is valued at up to $103,427.80.
13. Prizes cannot be transferred, exchanged or redeemed for cash. In the event a winner does not take the prize by the time stipulated, then the prize will be forfeited by the winner and cash will not be awarded in lieu of prize. Prizes must be taken as offered and cannot be varied. Any unused portion of the prize is not-transferable, non-refundable and non-redeemable for other goods or services and cannot be taken as cash.
14. A draw for any unclaimed prizes may take place on 04/02/11, subject to any directions from a regulatory authority. Winners’ names will be published in Take 5 issue 10 on 03/03/11.
15. The Promoter encourages consumers to enjoy responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health & Medical Research Council Australian Alcohol Guidelines that are available at www.nhmrc.gov.au. The resort and the Promoter take no responsibility for any alcohol related incidents.
16. Any change in the value of the prize between publishing date and the date prize is claimed is not the responsibility of the Promoter.
17. Ineligible, illegible or incomplete claims and entries received will be considered null and void. Instant win game materials are rendered void if stolen, forged, mutilated, incomplete or tampered with in any way. Photocopied or faxed claims and entries will not be accepted.
18. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
19. Printing and other quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess of the advertised prize pool will be honoured. Any instant win prizes that are part of the advertised total prize pool will be awarded in the unclaimed prize draw.
20. Instant win game materials void if stolen, forged, mutilated or tampered with in any way. There will be a total of 620,000 instant win cards printed for this promotion.
21. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these terms and conditions; (e) any tax liability incurred by a winner or entrant; or (f) a prize.
22. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.

Take 5 and Lucky Break Issue 36, 2010 Promotion Terms and Conditions
1. Instructions on how to enter and prizes form part of these Terms and Conditions. Participating in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to residents of Australia who purchase Take 5 magazine or residents of New Zealand who purchase Lucky Break magazine. Purchase must be from an authorised outlet during the promotional period. Employees of the Promoter, their immediate families and agencies associated with this promotion are ineligible to enter.
3. Entrants under 16 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to all terms and conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to this Promotion.
4. Consumers can enter by using the official entry coupon or instant win coupon provided in the magazine. Where applicable, Australian residents can also enter by phoning the relevant 190 number and leaving their details or by sending via SMS the keyword relevant to the prize they wish to win and their requested details to the relevant SMS number. Mail entries are to be sent to the PO Box as published in the magazine. Consumers may enter as many times as they wish, however, each mail entry must be posted in a separate stamped business-sized envelope (220mm x 110mm or smaller) and contain an official entry coupon. Only original entry forms from magazines in official circulation are valid. Entries from newsagents' returns will not be accepted. Only one prize will be awarded per person, excluding SA residents in Australia and excluding Instant Win, 190 and SMS competitions. For the sake of clarity, except for SA residents, their entry will not be entered back into the draw or included in the unclaimed prize draw. SMS and 0900 competitions are not available in New Zealand.
5. The Promoter reserves the right, at any time, to verify the validity of claims and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process (including but not limited to tampering by way of use of techniques designed to avoid the payment of SMS or 190 call costs). Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. Errors and omissions will be accepted at the Promoter's discretion. Identification considered suitable for verification includes a driver's license or passport. Acceptance of alternative identification as verification is at the complete discretion of the Promoter.
6. Unless otherwise indicated, Australian promotions commence on 1/9/10. Unless otherwise indicated, New Zealand promotions commence on 2/9/10. Unless otherwise indicated, mail entries for Issue 36 in Australia and New Zealand close last mail received, and phone entries close at 11:59pm AEDT/NZ time on 17/9/10.
7. Unless otherwise indicated, the draw for mail entries will take place at National Products Fulfilment Pty Ltd, 6 Ross Place, Wetherill Park, NSW 2164 and the draw for the 190 and SMS entries will take place at 5th Finger Pty Ltd, Level 7, 264 George Street, Sydney, NSW 2000 at 9:30am AEDST for Issue 36 on 24/9/10. Unless otherwise indicated, Australian winners will be notified by mail and the names of winners of prizes valued at over AUD$250 will be published in Issue 42 on sale 13/10/10. Unless otherwise indicated, New Zealand winners will be notified by mail and the names of winners of prizes valued at over AUD$250 will be published in Issue 42 on sale 14/10/10.
8. Maximum cost of a 190 call in Australia is AUD$0.55 cents including GST. Calls to the 190 numbers from mobiles may attract a higher rate. Service not available from payphones. 190 service provider is 5th Finger Pty Ltd. Premium SMS cost in Australia is AUD$0.55 cents including GST. Entrants must have premium service access in Australia. SMS entries via the internet are not valid and will not be accepted. SMS service provider in Australia is 5th Finger Pty Ltd. Individuals under the age of 15 must obtain bill payer's permission to send an SMS or call the 190 numbers.
9. The Promoter may conduct further draws as are necessary at 11am AEDST on 23/12/10 for Issue 36 at National Products Fulfillment Pty Ltd of 6 Ross Place, Wetherill Park, NSW 2164 and at 5th Finger Pty Ltd of Level 7, 264 George Street, Sydney, NSW 2000, in order to distribute any prizes unclaimed by that date subject however to any written directions from any regulatory authority. The winners of prizes in the unclaimed prize draw will be notified by mail and the winners of prizes over AUD$250 will be published in Issue 4 of Take 5 magazine in Australia (on sale 19/1/11) and in Issue 4 in Lucky Break magazine in New Zealand (on sale 20/1/11).
10. The Bonus Draw for all entries received from Issue 36 will take place at National Products Fulfillment Pty Ltd, 6 Ross Place, Wetherill Park, NSW 2164 on 23/12/10 at 12pm AEDST. The first valid entry drawn from all entries from Issues 36 for the Bonus Draw prize will win AUD$100.The winner of the Bonus Draw will be notified by mail.
11. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash unless otherwise stipulated.
12. Unless otherwise stated all prizes are in Australian dollars. Some prizes may not be available or prohibited in New Zealand under New Zealand law. In that case prizes will be offered to an equivalent New Zealand dollar value either in cash, vouchers or as a prize determined by the Promoter in its absolute discretion.
13. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
14. Where travel is involved in the prize, the winner will be responsible for taxes, spending money, additional meals, insurance, transport to and from departure point, transfers, passports, visas and all other ancillary costs unless otherwise stipulated. Travel is subject to booking and flight availability.
15. Any ancillary costs associated with redeeming any voucher prize are not included. Any unused balance of a voucher prize will not be awarded as cash. Redemption of any voucher prize will be subject to any terms and conditions of the issuer including those specified on the voucher. The Promoter shall not be liable for any voucher prize that has been lost, stolen, forged, damaged or tampered with in any way.
16. Unless otherwise due to fraud or ineligibility under these terms and conditions, all valid prize claims in excess of the advertised prize pool will be honoured. All advertised instant prizes will be awarded.
17. Quality control errors will not invalidate an otherwise valid prize claim. All valid claims for prizes and entitlements will be met.
18. Ineligible, illegible, inaudible, incomprehensible or incomplete claims or entries received will be considered null and void. Instant win game materials are rendered void if stolen, forged, mutilated, incomplete or tampered with in any way. Photocopied or faxed claims or entries will not be accepted.
19. The Promoter's decision in relation to all aspects of this promotion is final and no correspondence will be entered into.
20. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to (a) disqualify any entrant; and (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
21. 22. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photography, film and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
23. All entries become the property of the Promoter. The collection, use and disclosure of personal information provided in connection with this competition is governed by the Privacy Notice (see the Contents page for location of our Privacy Notice).

Take 5 and Lucky Break Issue 35, 2010 Colouring Competition Terms and Conditions
1. Instructions on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. The competition is only open to residents of Australia and New Zealand. Entrants must obtain the permission of a parent or guardian to enter. Employees of the Promoter, their immediate families and agencies associated with this promotion are ineligible to enter.
3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Terms and Conditions. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. Errors and omissions will be accepted at the Promoter's discretion.
4. Promotion commences 25/8/10. Entries close last mail received on 10/9/10. The promotion is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based on artistic and creative merit. The Promoter’s and/or judges’ decision in relation to all aspects of this promotion is final and binding on all who enter and no correspondence will be entered into.
5. To enter, entrants must colour in the original Kids picture printed in Take 5 Issue 35 (on sale 25/8/10) and complete the original entry coupon also printed in Take 5 Issue 35. Entrants are to send the completed coupon and together with their coloured-in picture in a stamped envelope to: Take 5 Colouring in Competition, PO Box 435, Eastern Suburbs MC, NSW 2004. Multiple entries are accepted but each entry must contain an original entry coupon and sent in a separate stamped envelope. Only one prize per person. Incomplete, illegible and invalid entries will not be included in the judging.
6. The best 30 valid entries, as determined by the judges, will win a Scholastic book pack, valued at $102.91 each.
7. Total prize pool valued at $3087.30. Winners will be notified by mail using the contact details provided on their entry coupon.
8. Prizes, and any unused portion of the prizes, are not transferable or exchangeable and cannot be taken as cash.
9. In the event that the prize is not available, the Promoter reserves the right to substitute a prize in their sole discretion to the same and equal recommended retail value and/or specification.
10. 1. Instructions on how to enter and prizes form part of these Terms and Conditions. Participating in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to residents of Australia who purchase Take 5 magazine or residents of New Zealand who purchase Lucky Break magazine. Purchase must be from an authorised outlet during the promotional period. Employees of the Promoter, their immediate families and agencies associated with this promotion are ineligible to enter.
3. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to all terms and conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to this Promotion.
4. Consumers can enter by using the official entry coupon or instant win coupon provided in the magazine. Where applicable, Australian residents can also enter by phoning the relevant 190 number and leaving their details or by sending via SMS the keyword relevant to the prize they wish to win and their requested details to the relevant SMS number. Mail entries are to be sent to the PO Box as published in the magazine. Consumers may enter as many times as they wish, however, each mail entry must be posted in a separate stamped business-sized envelope (220mm x 110mm or smaller) and contain an official entry coupon. Only original entry forms from magazines in official circulation are valid. Entries from newsagents' returns will not be accepted. Only one prize will be awarded per person excluding SA residents in Australia. For the sake of clarity, except for SA residents, their entry will not be entered back into the draw or included in the unclaimed prize draw. For 190 and SMS competitions only, but not including Instant Win 190 and SMS competitions, one prize will be awarded per person, excluding SA residents in Australia. SMS and 0900 competitions are not available in New Zealand.
5. The Promoter reserves the right, at any time, to verify the validity of claims and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process (including but not limited to tampering by way of use of techniques designed to avoid the payment of SMS or 190 call costs). Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. Errors and omissions will be accepted at the Promoter's discretion. Identification considered suitable for verification includes a driver's licence or passport. Acceptance of alternative identification as verification is at the complete discretion of the Promoter.
6. Unless otherwise indicated, Australian promotions commence for Issue 29 on 14/7/10. Unless otherwise indicated, New Zealand promotions commence for Issue 25 on 15/7/10. Unless otherwise indicated, mail entries for Issue 29 in Australia and New Zealand close last mail received, and phone entries close at 11:59pm AEDT/NZ time (where applicable) for Issue 29 on 30/7/10.

Unless otherwise indicated, the draw for mail entries will take place at National Products Fulfilment Pty Ltd, 6 Ross Place, Wetherill Park, NSW 2164 and the draw for the 190, 0900 and SMS entries will take place at 5th Finger Pty Ltd, Level 7, 264 George Street, Sydney, NSW 2000 at 9:30am AEST for Issue 29 on 6/8/10. Unless otherwise indicated, Australian winners will be notified by mail and the names of winners of prizes valued at over AUD$250 will be published in Issue 35 of Take 5 magazine in Australia on sale 25/8/10. Unless otherwise indicated, New Zealand winners will be notified by mail and the names of winners of prizes valued at over AUD$250 will be published in Issue 35 of Lucky Break magazine in New Zealand, on sale 26/8/10.
8. Maximum cost of a 190 call in Australia is AUD$0.55 cents including GST. Calls to the 190 numbers from mobiles may attract a higher rate. Service not available from payphones. 190 service provider is 5th Finger Pty Ltd. Premium SMS cost in Australia is AUD$0.55 cents including GST. Entrants must have premium service access in Australia. SMS entries via the internet are not valid and will not be accepted. SMS service provider in Australia is 5th Finger Pty Ltd. Individuals under the age of 15 must obtain bill payer's permission to send an SMS or call the 190 numbers.
9. The Promoter may conduct further draws as are necessary at 11am AEDT on 12/11/10 for Issue 29 at National Products Fulfilment Pty Ltd of 6 Ross Place, Wetherill Park, NSW 2164 and at 5th Finger Pty Ltd of Level 7, 264 George Street, Sydney, NSW 2000, in order to distribute any prizes unclaimed by that date subject however to any written directions from any regulatory authority. The winners of prizes over AUD$250 will be published in Issue 50 of Take 5 magazine in Australia (on sale 8/12/10) and in Issue 50 in Lucky Break magazine in New Zealand (on sale 9/12/10).
10. The Bonus Draw for all entries received from Issue 29 will take place at National Products Fulfilment Pty Ltd, 6 Ross Place, Wetherill Park, NSW 2164 on 5/11/10 at 12pm AEDST. The first valid entry drawn from all entries from Issue 29 for the Bonus Draw prize will win AUD$100. The winner from the Bonus Draw will be notified by mail.
11. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash unless otherwise stipulated.
12. Unless otherwise stated all prizes are in Australian dollars. Some prizes may not be available or prohibited in New Zealand under New Zealand law. In that case prizes will be offered to an equivalent New Zealand dollar value either in cash, vouchers or as a prize determined by the Promoter in its absolute discretion.
13. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
14. Where travel is involved in the prize, the winner will be responsible for taxes, spending money, additional meals, insurance, transport to and from departure point, transfers, passports, visas and all other ancillary costs unless otherwise stipulated. Travel is subject to booking and flight availability.
15. Any ancillary costs associated with redeeming any voucher prize are not included. Any unused balance of a voucher prize will not be awarded as cash. Redemption of any voucher prize will be subject to any terms and conditions of the issuer including those specified on the voucher. The Promoter shall not be liable for any voucher prize that has been lost, stolen, forged, damaged or tampered with in any way.
16. Unless otherwise due to fraud or ineligibility under these terms and conditions, all valid prize claims in excess of the advertised prize pool will be honoured. All advertised instant prizes will be awarded.
17. Quality control errors will not invalidate an otherwise valid prize claim. All valid claims for prizes and entitlements will be met.
18. Ineligible, illegible, inaudible, incomprehensible or incomplete claims or entries received will be considered null and void. Instant win game materials are rendered void if stolen, forged, mutilated, incomplete or tampered with in any way. Photocopied or faxed claims or entries will not be accepted.

Take 5 Club Member of the Week Competition
Terms and Conditions
1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to Australian residents who are or become members of the Take 5 Club during the promotional period. Employees (and their immediate families) of the Promoter, authorised outlets and agencies associated with this promotion are ineligible.
3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. Errors and omissions will be accepted at the Promoter's discretion.
4. Promotional period commences 30/6/10 and closes last mail received on 8/12/10. This is a game of skill and chance plays no part in determining the winners. The judges’ decision is final and no correspondence will be entered into.

All entries received will go into one judging each week to ensure that each entry has a fair and equal opportunity of winning. Non-winning entries in each round will be entered into any subsequent rounds. Each entry will be individually judged based on a combination of literary and creative merit and originality based on the answer provided to the question. For the sake of clarity, the photograph is for publication purposes only and will not form part of the judging criteria.
7. There will be 13 rounds in total for each week of the promotional period. Entries close for each round last mail received each Tuesday between 6/7/10 and 14/12/10 inclusive. Each week during the promotional period, the judges will select the best entry and will deem that entry the winner. There is one winner selected each week with a total of 13 winners selected over the entire promotional period. Take 5 Reverse Auction
Terms and Conditions
1. Bidding is open to all residents of Australia except employees and their immediate families of the Promoter and its agencies associated with the Take 5 Reverse Auction.
2. By entering any bid in the Take 5 Reverse Auction, bidders confirm they have read and understood these Terms and Conditions and are deemed to have accepted them.
3. The Take 5 Reverse Auction is open each Wednesday at 12:01am ADST/AEST from 30/6/10 to 22/12/10 and ends each Tuesday at 11:59pm ADST/AEST from 6/7/10 to 28/12/10.
4. To place a bid for the item(s) as printed on the Reverse Auction page in Take 5, consumers SMS the word BID and their bid in whole cents to the SMS number printed on the page during the relevant bidding period. All bids are to be in Australian cents and include GST. Cost of each SMS message sent is $0.55 including GST.
5. All bids must be sent by SMS. SMS via the internet not accepted. Bids are deemed to be received at the time of receipt into the Reverse Auction database and NOT at the time of transmission by the bidder.
6. All bids must be submitted by an individual and must not be computer generated. The use of any automated software or any other mechanical or electronic means that allows a bidder to automatically bid repeatedly is prohibited and will render all bids submitted by that bidder invalid.
7. The SMS entry mechanic is only open to consumers with an SMS compatible mobile phone connected to a service provider which permits text messaging to premium SMS numbers. Premium SMS service provider is 5th Finger Pty Ltd.
8. Once a bid has been submitted, consumers will receive a reply SMS message, notifying them that (a) their bid is currently the lowest unique bid; or (b) their bid is currently unique but not the lowest bid; or (c) their bid is not unique; or (d) their bid is invalid. SMS messages will be sent throughout the course of the bidding if the bid changes from one of these categories to another.
9. All bids are processed in the order that they are received into the database. No responsibility accepted for any late, lost, incomplete, incomprehensible, incorrect, delayed or misdirected bids as a result of technical disruptions or for any other reason.
10. The Promoter reserves the right to verify the validity of bids and to disqualify any bidder who tampers with the bid process or who places a bid that is not in accordance with these Terms and Conditions. Successful bidder must provide proof of identity, proof of residency and proof of relevant mobile bill before item will be dispatched. Pre-paid mobile users will be required to provide proof of purchase of all pre-paid recharge cards. Acceptance of alternate identification as verification is at the complete discretion of the Promoter.
11. A new item(s) will be offered for bidding each week during the Take 5 Reverse Auction. The consumer who has placed the lowest unique bid that week will be deemed the successful bidder for the lot on offer for that week just ended. The lowest unique bid is the lowest value offered (in whole cents) for the lot, which has not been offered by any other bidder for that lot. If there is no lowest unique bid, the successful bidder is determined by the lowest bid amount with exactly two bids. The first bidder to have placed the bid is determined the winner. If this does not produce a winner (if there is no low unique bid with exactly two bids the same) the process keeps repeating for the highest bid amount with exactly three bids. This will continue until a successful bidder is determined.
12. By placing a bid during the bidding period, consumers are offering to buy the relevant lot at that price as accepted by the Promoter. Ownership and title in the item does not pass to the successful bidder until the Promoter receives full and clear payment, and risk in the item passes to the successful bidder when the Promoter dispatches the item to the successful bidder.
13. The successful bidder of a lot will be notified at the end of the bidding period by phone, to arrange payment for the lot. If the successful bidder does not contact us to pay for the lot within 14 business days of first contact, then the bid is forfeited and the next lowest unique bidder will be contacted.
14. The successful bidder will be required to pay for the lot, at the price (being the successful bid rounded up to the nearest whole legal tender cent) placed by the person, within 14 business days of being notified of the bid's success. Payment will be accepted by Bankcard, Mastercard, Visa, Diners, Amex, cheque or money order. If payment is not received within 14 business days, the bidder will be deemed to have revoked the offer and will no longer be able to purchase the lot.
15. The lot will be delivered within 21 working days after payment is received to the address provided by the successful bidder.
16. If the lot (or any part of the lot) is unavailable, the Promoter, in its discretion, reserves the right to substitute the lot (or that part of the lot) with an item(s) to the equal value and/or specification.
17. The Promoter reserves the right in their absolute discretion to cancel, withdraw, reject, suspend or bar a bidder and their bid at any stage during the bidding period.
18. The Promoter's decision in relation to all aspects of the Take 5 Reverse Auction is final and no correspondence will be entered into.
19. If for any reason the Take 5 Reverse Auction is not capable of running as planned due to any reason (including but not limited to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes), including anything which may corrupt the integrity or proper conduct of the Take 5 Reverse Auction, the Promoter reserves the right to cancel, terminate, modify or suspend the auction.
20. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Take 5 Reverse Auction, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any bid that is late, lost, altered or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in the value of the lot as advertised in Take 5 magazine; (e) any tax liability incurred by a successful bidder or entrant; or (f) use of the lot/item.
21. As a condition of entry, successful bidders agree to provide information and a photograph of themselves for publicity purposes as requested by the Promoter. Bidders consent to the Promoter using their name, likeness, image and/or voice in the event they are successful (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting the Take 5 Reverse Auction (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
22. The Promoter reserves the right to amend these Terms and Conditions at any time.
