  1. By completing the Membership application form located at www.take5mag.com.au or using a Take 5 Club Card (hereafter the Card), each Member (and applicant) accepts and agrees to be bound by these Terms and Conditions and any variations made from time to time to these Terms and Conditions.
  2. Membership in the Program is only open to individuals who reside in Australia and is subject to acceptance of application. Individuals under the age of 18 years must have parental or legal guardian consent to become a Member of the Take 5 Club. Membership only established on receipt and acceptance of original application of the Member by the Promoter. The Promoter may refuse any application in their absolute discretion.
  3. To become a Member of the Program, the individual must complete a Membership application form available at www.take5mag.com.au. Please allow two weeks for the date of receipt of the application by the Promoter for delivery of Card.
  4. Only one Membership per person.
  5. Only original application forms from the Take 5 website (www.take5mag.com.au) will be accepted. Photocopies and facsimiles are not permitted.
  6. No responsibility is accepted for any late, lost or misdirected applications or Cards.
  7. Each Card will remain the property of the Promoter and must be returned on demand. It is not a credit or a payment card. Any lost Card may at the discretion of the Promoter be replaced. In the event of replacement the Member will be required to pay a replacement fee to the Promoter before delivery of the Card. A Member must notify the Promoter immediately if the Card is stolen or lost, at the Take 5 Contact Point. The Promoter is not liable for any delay in replacing a Card.
  8. Members Card can only be used by the Member who is named on the front of the Card and whose signature appears on the reverse.
  9. Membership entitles the Member to promotional offers, extra content and puzzles available on the Take 5 website, events, blogs and competitions. Notwithstanding the forgoing, nothing shall prevent the Promoter from offering promotional offers and competitions to individuals who are not Members. All promotional offers and competitions offered to Members will only be offered in accordance with the Terms and Conditions for those promotional offers and competitions.
  10. The Promoter in its sole discretion will determine what promotional offers are offered to Members and makes no guarantee as to the availability of any promotional offers.
  11. To the extent permitted by law, the Promoter will not be liable for any delays, disruptions, omissions or errors in the operation of the Program including technical or mechanical malfunctions, and will not be liable for any loss caused by any such delays, disruptions, omissions or errors.
  12. The Member acknowledges and agrees that all decisions pertaining to this Program rests solely with the Promoter and its decision is final. The Promoter in its sole discretion can at all times: (i) change, amend or vary these Terms and Conditions; (ii) change, amend, vary, withdraw or cancel any promotional offer offered to Members; (iii) exclude a Member from, or cancel a Members Membership in the Program, without prior notice and without prior notice to a Member. The Promoter gives no warranty as to the continuing availability of the Program. The Promoter may, in its absolute discretion, at any time cancel the Program in whole (or in part) upon reasonable notice (reasonable notice being no less than 1 week).
  13. Without limiting Clauses 11 and 12 in any way, Members will be taken to have received notice of any changes to these Terms and Conditions if the Promoter notifies the Member of the change by any method including, but not limited to the use of email and or posting details of the changes on the Promoter’s website.
  14. Without in any way limiting the rights of the Promoter, if a Member is in breach of these Terms and Conditions, at any time, then the Promoter may cancel the Members Membership with the Program and any Member whose Membership is cancelled may no longer access Member promotional offers or any other related benefits.
  15. To the full extent permitted by law, the Promoter, its related bodies corporate, employees, directors, suppliers and agencies is not liable for any loss or damage suffered by Members resulting from such withdrawals, cancellations, variations or change as set out in Clauses 12, 13 or 14 or otherwise in the terms of, and arising out of this Program.
  16. Privacy: The Promoter collects personal information (“PI”) in order to conduct the Take 5 Club and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Membership is conditional on providing this PI. The Promoter will also use and handle PI as set out in its privacy policy, which can be accessed by visiting http://www.bauer-media.com.au/privacy.htm.In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may also, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the member. Members should direct any request to opt out, access, update or correct PI to the Promoter and direct any complaints regarding treatment of their PI according to the Privacy Policy. All memberships become the property of the Promoter. Entrants’ PI will not be disclosed to any entity outside of Australia.
  17. The Terms and Conditions and Membership in the Program are governed by and will be construed in accordance with the laws of the State of NSW, irrespective of where the application for membership has been completed by the Member or submitted.
  18. Nothing in these Terms and Conditions affects any rights a Member may have and which by law may not be excluded under any statute including the Competition and Consumer Act (2010).

Instructions on how to enter and prizes form part of these conditions of entry. Participation in this promotion is deemed acceptance of these conditions of entry.

Entry is open to residents of Australia. Entrants under the age of 18 years must have prior parental or legal guardian consent to enter. Employees of the Promoter, and their immediate families and agencies associated with this promotion are not eligible to enter.

The promotional period commences 30th April 2015 and closes last mail 26th June 2015. The judging will be done by a panel of judges appointed by the Promoter. The judging will take place at the Promoter’s premises and will begin on the 3rd July 2015. The winner will be notified by email and phone using contact details provided in their entry.

To enter individuals must send their entry to Take 5, GPO Box 3525 Sydney NSW 2001 and include the following details: full name, address, current email address, daytime telephone number and answer to the competition question – in 25 words or less tell us “Why are you a fan of James Patterson’s crime novels?”

This is a game of skill. Chance plays no part in determining the winner. Each entry will be individually judged based on its literary and creative merit of the answer to the question provided. The judges’ decision in relation to any aspect of the competition will be final and binding on every person who enters. No correspondence will be entered into.

The Entrant warrants to the Promoter that the entry submitted is an original artistic work of the Entrant that does not infringe the rights of any third parties. If the entry or any part of the information provided to the Entrant in relation to the entry was provided by a third party, the Entrant warrants that they have obtained the relevant copyright permission to submit the entry for the purposes of this promotion. The entrant agrees to indemnify the promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition.

Entry is only open to residents of Australia who purchase Take 5 magazine or residents of New Zealand who purchase Lucky Break magazine. Purchase must be from an authorised outlet during the promotional period. Employees of the Promoter, their immediate families and agencies associated with this promotion are ineligible to enter.

SMS and 1900 competitions are not available in New Zealand.

Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to all terms and conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to this Promotion.

Consumers can enter by using the official entry coupon provided in the magazine. Where applicable, Australian residents can also enter by phoning the relevant 190 number and leaving their details or by sending via SMS the keyword relevant to the prize they wish to win and their requested details to the relevant SMS number. Mail (for Australian and New Zealand residents) entries are to be sent to the PO Box as published in the magazine. Consumers may enter as many times as they wish, however, each mail entry must be posted in a separate stamped business-sized envelope (220mm x 110mm or smaller) and contain an official entry coupon. Only original entry forms from magazines in official circulation are valid. Entries from newsagents’ returns will not be accepted. Only one prize will be awarded per person, per puzzle, excluding SA residents in Australia and excluding 190 and SMS competitions. For the sake of clarity, except for SA residents, a winner’s entry will not be entered back into the draw or included in the unclaimed prize draw. Unless otherwise indicated, New Zealand Lucky Break Magazine promotions commence on 24th August 2015. Unless otherwise indicated, mail entries for Issue 36 in New Zealand close last mail received on 7th September 2015.

Australia Only: Unless otherwise indicated, the draw for the 190 and SMS entries received from Australian Take 5 Magazine will take place at Salmat Digital Pty Ltd, Level 2, 116 Miller Street, North Sydney NSW 2060 at 9:30am (AEDST) for Issue 36 on 9th October 2015.

All winners will be notified in writing within two (2) business days of the draw and the names of winners of prizes valued at over AUD$250 will be published in Take 5 Issue 46 on sale 5th November 2015.

Unless otherwise stated all prizes are in Australian dollars. Some prizes may not be available or prohibited in New Zealand under New Zealand law. In that case prizes will be offered to an equivalent New Zealand dollar value either in cash, vouchers or as a prize determined by the Promoter in its absolute discretion.

All entries received will be entered into the Bonus Draw. The Bonus Draw will take place at National Products Fulfillment Pty Ltd, 6 Ross Place, Wetherill Park, NSW 2164 on 9th October 2015 at 12pm (noon) (AEST). The first valid entry drawn from all entries received for the Bonus Draw prize will win AUD$100. The winner of the Bonus Draw will be notified in writing within two (2) business days of the draw. In the event that the Bonus Draw prize remains unclaimed, the Promoter may conduct further draws as are necessary at 11am (AEDST) on 24th June 2016 at the same place as the Bonus Draw, in order to distribute the prize, subject however to any written directions from any regulatory authority. The winner, if any, will be notified in writing within two (2) business days of the draw.

Prize terms:

Any ancillary costs associated with redeeming any prize are not included. These are the responsibility of the winner.

In the event that a portion of a prize is awarded to the winner in the form of a voucher / ticket / pass/ letter, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher / ticket / pass/ letter. The Promoter will not be liable for any voucher / ticket / pass/ letter that has been lost, stolen, forged, damaged or tampered with in any way. Redemption of a prize at a venue is subject to the standard rules and regulations of that venue/s.

Car Prize Terms:

Instructions on how to enter and prizes form part of these Terms and Conditions. Participating in this promotion is deemed acceptance of these Terms and Conditions.

Entry is only open to residents of Australia who purchase Take 5 magazine or residents of New Zealand who purchase Lucky Break magazine. Purchase must be from an authorised outlet during the promotional period. Employees of the Promoter, their immediate families and agencies associated with this promotion are ineligible to enter.

SMS and 1900 competitions are not available in New Zealand.

Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to all terms and conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to this Promotion.

Consumers can enter by using the official entry coupon provided in the magazine. Purchase must be from an authorised outlet during the promotional period. Employees of the Promoter, their immediate families and agencies associated with this promotion are ineligible to enter. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to all terms and conditions. Car Prize Terms

Vehicle prize includes 12-months registration and on road costs but excludes comprehensive insurance (or in the case of a New Zealand winner – third party insurance) petrol, transport and damage from date of delivery. Colour of vehicle is at the sole discretion of the Promoter. Vehicles won in New Zealand may differ in model and specification to those promoted.

If the winner of the vehicle prize is under the age of 16 years, the prize will be awarded to the winner’s nominated parent or guardian on the winner’s behalf. Any additional optional extras and accessories, comprehensive insurance and any other insurance, fuel personal costs and any other ancillary costs associated with redeeming the prize are excluded and are the responsibility of the winner. Vehicle prize includes 12-months registration and on road costs but excludes comprehensive insurance (or in the case of a New Zealand winner – third party insurance) petrol, transport and damage from date of delivery. If the winner of the vehicle prize is under the age of 16 years, the prize will be awarded to the winner’s nominated parent or guardian on the winner’s behalf. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who does not participate in accordance with these Terms and Conditions or who tampers with the entry process. The entire promotional period commences on Thursday 26/02/2015 and closes on 11:59pm (AEST) on Wednesday 09/09/2015. There will be a draw conducted each Thursday from 05/03/2015 to 10/09/2015 inclusive, excluding NSW public holidays in which case the draw will take place the following business day. Each draw corresponds to an Issue of Take 5 in which a Take 5 Club Badge Number will be published, from Issue 10 (2015) to Issue 37 (2015) inclusive. The Promoter will publish the drawn Take 5 Club Badge number from each draw online at www.take5mag.com.au each Thursday from 19/03/2015 to 24/09/2015 inclusive. All un-drawn entries in each draw will be carried over into the subsequent draws.

The Promoter reserves the right to draw additional reserve entries (and record them in order), in the event that an invalid entry is drawn or an entrant drawn is ineligible.

An entrant (except residents of SA, due to SA legislation) is limited to being drawn once during the course of the promotion.

To be eligible to enter, each entrant must be a current or new member of the Take 5 online Club and have a registered Take 5 online Club Badge Number as of 11:59pm AEST/AEDST each Wednesday (day prior to each individual draw period).Each eligible Take 5 member must purchase Take 5 Issues 10 (2015) to 37 (2015) on sale between 26/02/2015 and 30/09/2015 and check to see if their name and Take 5 online Club Badge Number has been drawn for that issue. If the entrant’s Take 5 online Club Badge Number has been printed in the magazine, that entrant is entitled to claim a prize.To claim a prize: the valid drawn member must, within seven (7) days of the on sale date of the issue in which their drawn number was printed, visit www.take5club.com.au and follow the prompts to the Take 5 club badge claim form and confirm their details including name, address and daytime telephone number. If a drawn member does not complete this requirement and claim the prize by the relevant close date, then their prize is forfeited and the value of the prize available will be carried over to the next week’s prize pool as part of a jackpot for the next drawn member to redeem. For the avoidance of doubt, the final date for which the final prize for the final issue (Issue 10 2015) may be claimed will be 11:59pm (AEDST) on 30/09/2015.

The names and badge numbers of drawn members who successfully claim a prize will be published in the relevant Take 5 Issues 17 (2015) to 44 (2015), on sale each Thursday from 16/04/2015 to 22/10/2015. Each Member (winner) may be asked to present their Take 5 Club membership number and identification at the prize delivery address in order to receive their prize. The Promoter’s decision is final and no correspondence will be entered into.

In the event that Take 5 magazine printing is changed, delayed or cancelled, the winner announcements that were scheduled for that relevant Take 5 magazine issue will be carried out in the following available issue.

The Promoter reserves the right to request that winners provide proof of identity. Identification considered suitable for verification is at the discretion of the Promoter.

Prize:

The minimum prize pool to be won in each individual draw period is $1,000. Any monies that are not successfully claimed in accordance with Clause 8 will be added to the next draw’s prize pool. The maximum prize pool available to be won in an individual draw period is $27,000. For the removal of doubt, the maximum prize value would only be awarded if no drawn members successfully claimed a prize for Issues 08 (2015) to 40 (2015), or in the event of an unclaimed prize draw in which there had been no valid claims for prize money received during the entire promotional period.

The total maximum prize pool available is $27,000 (including GST). Prizes will be awarded in the form of a cheque made in favour of the winner. Any ancillary costs associated with redeeming the prize are not included. These are the responsibility of the winner.

In the event that as at 30/09/2015 there is still unclaimed prize money, all undrawn entries will be entered into the unclaimed prize draw, to be conducted at 11:00am (AEDST) on 14/12/2015 at the Bauer Media, 54 Park Street, Sydney NSW 2000. The first valid entry drawn will be awarded any unclaimed prize money. For the avoidance of doubt, this will be a minimum prize pool of $1,000 and a maximum prize pool of $27,000. Prize winner is advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize.

If the winner is under the age of 18 years, the prize will be awarded to the winner’s parent or legal guardian on behalf of the winner. It is the responsibility of the winner’s parent/legal guardian to prove their parental status/ legal guardianship at the time of winner notification. In the event that for any reason whatsoever a person/s mistakenly represents themselves to be a winners parent and/or legal guardian, then that person will be liable for all costs associated with relocating and/or re-awarding the prize (including but not limited to and administrative fees incurred by the Promoter). Where relevant., the Promoter is only responsible for ensuring that the prize is awarded to a person who is either a parent or legal guardian of the winner. Payment will be accepted by Bankcard, Mastercard, Visa, Diners, Amex, cheque or money order. If payment is not received within 14 business days, the bidder will be deemed to have revoked the offer and will no longer be able to purchase the lot.
  15. The lot will be delivered within 21 working days after payment is received to the address provided by the successful bidder.
  16. If the lot (or any part of the lot) is unavailable, the Promoter, in its discretion, reserves the right to substitute the lot (or that part of the lot) with an item(s) to the equal value and/or specification.
  17. The Promoter reserves the right in their absolute discretion to cancel, withdraw, reject, suspend or bar a bidder and their bid at any stage during the bidding period.
  18. The Promoter’s decision in relation to all aspects of the Take 5 Reverse Auction is final and no correspondence will be entered into.
  19. If for any reason the Take 5 Reverse Auction is not capable of running as planned due to any reason (including but not limited to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes), including anything which may corrupt the integrity or proper conduct of the Take 5 Reverse Auction, the Promoter reserves the right to cancel, terminate, modify or suspend the auction.
  20. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  21. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees,  the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Take 5 Reverse Auction: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any bid that is late, lost, altered or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a successful bidder or entrant; or (e) use of the lot/item.
  22. As a condition of entry, successful bidders agree to provide information and a photograph of themselves for publicity purposes as requested by the Promoter. Bidders consent to the Promoter using their name, likeness, image and/or voice in the event they are successful (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting the Take 5 Reverse Auction (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  23. The Promoter reserves the right to amend these Terms and Conditions at any time.
  24. Privacy: The Promoter collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its privacy policy, which can be accessed by visiting http://www.bauer-media.com.au/privacy.htm. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may also, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct PI to the Promoter and direct any complaints regarding treatment of their PI according to the Privacy Policy. All entries become the property of the Promoter.
