Club Membership terms and conditions In these Terms and Conditions: Take 5 Club Card means a membership card issued pursuant to this Program; Member means an individual who is an Australian resident whose application to take part in the Program is accepted; Membership means membership in this Program. Program means the Take 5 Club operated pursuant to these Terms and Conditions by the Promoter; Promoter is Bauer Media Pty Ltd, 54 Park Street, Sydney, NSW 2000 (ABN 18 053 273 546) Telephone: 02 9282 8000. Take 5 Contact Point is Take 5 Club, PO Box 408, Eastern Suburbs MC, NSW 2004 or email at take5club@bauer-media.com.au.

  1. By completing the Membership application form located at www.take5mag.com.au or using a Take 5 Club Card (hereafter the Card), each Member (and applicant) accepts and agrees to be bound by these Terms and Conditions and any variations made from time to time to these Terms and Conditions.
  2. Membership in the Program is only open to individuals who reside in Australia and is subject to acceptance of application. Individuals under the age of 18 years must have parental or legal guardian consent to become a Member of the Take 5 Club. Membership only established on receipt and acceptance of original application of the Member by the Promoter. The Promoter may refuse any application in their absolute discretion.
  3. To become a Member of the Program, the individual must complete a Membership application form available at www.take5mag.com.au. Please allow two weeks for the date of receipt of the application by the Promoter for delivery of Card.
  4. Only one Membership per person.
  5. Only original application forms from the Take 5 website (www.take5mag.com.au) will be accepted. Photocopies and facsimiles are not permitted.
  6. No responsibility is accepted for any late, lost or misdirected applications or Cards.
  7. Each Card will remain the property of the Promoter and must be returned on demand. It is not a credit or a payment card. Any lost Card may at the discretion of the Promoter be replaced. In the event of replacement the Member will be required to pay a replacement fee to the Promoter before delivery of the Card. A Member must notify the Promoter immediately if the Card is stolen or lost, at the Take 5 Contact Point. The Promoter is not liable for any delay in replacing a Card.
  8. Members Card can only be used by the Member who is named on the front of the Card and whose signature appears on the reverse.
  9. Membership entitles the Member to promotional offers, extra content and puzzles available on the Take 5 website, events, blogs and competitions. Notwithstanding the forgoing, nothing shall prevent the Promoter from offering promotional offers and competitions to individuals who are not Members. All promotional offers and competitions offered to Members will only be offered in accordance with the Terms and Conditions for those promotional offers and competitions.
  10. The Promoter in its sole discretion will determine what promotional offers are offered to Members and makes no guarantee as to the availability of any promotional offers.
  11. To the extent permitted by law, the Promoter will not be liable for any delays, disruptions, omissions or errors in the operation of the Program including technical or mechanical malfunctions, and will not be liable for any loss caused by any such delays, disruptions, omissions or errors.
  12. The Member acknowledges and agrees that all decisions pertaining to this Program rests solely with the Promoter and its decision is final. The Promoter in its sole discretion can at all times: (i) change, amend or vary these Terms and Conditions; (ii) change, amend, vary, withdraw or cancel any promotional offer offered to Members; (iii) exclude a Member from, or cancel a Members Membership in the Program, without prior notice and without prior notice to a Member. The Promoter gives no warranty as to the continuing availability of the Program. The Promoter may, in its absolute discretion, at any time cancel the Program in whole (or in part) upon reasonable notice (reasonable notice being no less than 1 week).
  13. Without limiting Clauses 11 and 12 in any way, Members will be taken to have received notice of any changes to these Terms and Conditions if the Promoter notifies the Member of the change by any method including, but not limited to the use of email and or posting details of the changes on the Promoter’s website.
  14. Without in any way limiting the rights of the Promoter, if a Member is in breach of these Terms and Conditions, at any time, then the Promoter may cancel the Members Membership with the Program and any Member whose Membership is cancelled may no longer access Member promotional offers or any other related benefits.
  15. To the full extent permitted by law, the Promoter, its related bodies corporate, employees, directors, suppliers and agencies is not liable for any loss or damage suffered by Members resulting from such withdrawals, cancellations, variations or change as set out in Clauses 12, 13 or 14 or otherwise in the terms of, and arising out of this Program.
  16. Privacy: The Promoter collects personal information (“PI”) in order to conduct the Take 5 Club and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Membership is conditional on providing this PI. The Promoter will also use and handle PI as set out in its privacy policy, which can be accessed by visiting http://www.bauer-media.com.au/privacy.htm.In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may also, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the member. Members should direct any request to opt out, access, update or correct PI to the Promoter and direct any complaints regarding treatment of their PI according to the Privacy Policy. All memberships become the property of the Promoter. Entrants’ PI will not be disclosed to any entity outside of Australia.
  17. The Terms and Conditions and Membership in the Program are governed by and will be construed in accordance with the laws of the State of NSW, irrespective of where the application for membership has been completed by the Member or submitted.
  18. Nothing in these Terms and Conditions affects any rights a Member may have and which by law may not be excluded under any statute including the Competition and Consumer Act (2010).

Our club is an editorial extension of our magazine containing editorial content and a place for discussion, queries and conversations pertaining to Take 5 as well as new initiatives, services and news from Bauer Media. The Following Community Guidelines are designed to help provide a quality environment for our members. Please take a minute to read them and keep them in mind whenever you participate. By providing your email address you consent to receipt of any email regarding this magazine, and other emails which inform you of Bauer Media’s other publications, products, services and events and to promote third party goods and services you may be interested in. Take 5 Club Dreamworld Promotion 2014 Terms and Conditions

  1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in the promotion is deemed acceptance of these Terms and Conditions.
  2. The promotion is open to Australian residents who are current or new members of the Take 5 Club during the promotional period. Employees of the Promoter, their immediate families, authorised outlets and agencies associated with this promotion are ineligible to enter. Only one entry per day is permitted per Club member.
  3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who does not participate in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. Errors and omissions will be accepted at the Promoter’s discretion.
  4. The entire promotion commences on Thursday 31 July 2014 and closes at 11:59pm (AEST) on Wednesday 22 October 2014. The draw will take place on Friday 31 October 2014 at 11.00am (AEST) at the Promoter’s premises, 54 Park St, Sydney NSW 2000. The winner will be notified in writing using the details given in their membership within two (2) business days of the draw, and the winner will be published in Take 5 issue 49, on sale 27 November 2014.
  5. The Promoter’s decision is final and no correspondence will be entered into.
  6. To become a member:

To become a member, individuals must go to Take 5 Club website at www.take5mag.com.au during the promotional period and follow the prompts to be become a member of the take 5 club and fill in the registration form including full name, address, current email address, date of birth and daytime telephone number. After registration, an email will be sent to the individual from Take 5 Magazine (Promoter) including their Club membership number. 7.     Entry: New Members: To enter, new members must visit www.take5mag.com.au during the promotional period and become a member of the Take 5 club as stipulated in clause 6 and then sign in to their club account during the promotional period and follow the prompts to the competitions tab “win a Dreamworld holiday” and submit their entry as instructed Current Members with no log in to the Take 5 club section: To enter, current members must visit www.take5mag.com.au during the promotional period and create a Club account by following the prompts to the sign up to the Take 5 Club and fill in the application form including their full name, address, current email address, date of birth and daytime telephone number and press sign in and then follow the prompts to the competitions tab “win a Dreamworld holiday”. Current Members with a log in to the Take 5 club section: To enter, current members must visit www.take5mag.com.au during the promotional period, sign in to their club account during the promotional period and follow the prompts to the competitions tab “win a Dreamworld holiday” and submit their entry as instructed”.

  1. 8.     Prize:

The first two (2) valid entries drawn from all valid entries received will win: One Dreamworld Holiday for 2 Adults and 2 Children (0-12 yrs inclusive), valued at up to $11,643.92 each. Each holiday includes:

    • Return airfares for 2 adults and 2 children (0-12 yrs) from the winner’s nearest major airport to Gold Coast or Brisbane,  valued at up to $4012
    • 3 Nights’ Accommodation for four in a Resort Room at Paradise Resort Gold Coast, valued at up to $1167
    • 21 day Holiday World Pass for four people (Up to 21 consecutive days of unlimited entry to Dreamworld, WhiteWater World and SkyPoint Observation Deck) valued at up to $719.92
    • Tiger Photo Experience, valued at $345 (participants must be over 10 years of age)
    • One hour VIP access to the Big 9 Thrill Rides at Dreamworld before the park opens, valued at $5,000
    • Return Hotel Transfers (airport to hotel), valued at up to $100
    • Two Days of return Dreamworld transfers, valued at up to $300

The total prize pool is valued at $23,287.84 (including GST). Prize does not include any ancillary costs associated with redeeming this prize. These are the responsibility of the winner.

  1. Prize must be taken as offered. The prize, or any unused portion of the prize, is not exchangeable or cannot be redeemed as cash. The prize cannot be used in conjunction with any other special offer. The prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. Prize winner is advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize.  All elements of the prize are valid for 2 adults and 2 children (0-12yrs inclusive), subject to age and safety restrictions.
  2. To take part in the Tiger Photo Experience, participants must be over 10 years of age and up to 15 years must be accompanied by a paid participating Adult. This portion of the prize is subject to age and safety restrictions.
  3. VIP access to the Big 9 Thrill Rides is subject to height and safety regulations of each ride and prize winners must remain with their host at all times until Dreamworld opens to the public.  Thrill rides are subject to closure for maintenance issues.
  4. The prize is subject to availability, cannot be taken during Australian school holidays (inclusive of all Australian States) or during Gold Coast 600 Event dates, and is valid for a period of 12 months from the original draw date. Validity date of this prize cannot be extended.
  5. The prize winner will be required to provide at least 3 weeks notice of intent to travel.   All components of prize are subject to availability at time of booking.
  6. If the winner resides within a 3-hour drive or 240km from Dreamworld and WhiteWater World, airfares and car rental are not included in the prize.
  7. Once booked, any changes made to the booking may incur a cancellation fee of amendment fee, at the cost of the winner.  The winner of the prize (and their travel companions) will not accrue any frequent flyer points from taking the prize.
  8. All components of the prize must be taken together. Travel Insurance is not included. Travel Prize does not include meals, spending money or transport to and from departure and arrival points. All other ancillary and travel costs are the winner’s responsibility.  All additional costs incurred whereby the prize winner wishes to make variations to the travel are the winner’s responsibility and must be booked separately by the winner.  All travel variations are subject to approval by Ardent Leisure Limited upon booking.  Travel variations include, but are not limited to extension of travel duration, travellers outside of the age restriction and additional travellers.
  9. Prizes cannot be transferred, exchanged or redeemed for cash. In the event a winner does not take the prize by the time stipulated, then the prize will be forfeited by the winner and cash will not be awarded in lieu of prize.  Prizes must be taken as offered and cannot be varied.  Any unused portion of the prize is not-transferable, non-refundable and non-redeemable for other goods or services and cannot be taken as cash.
  10. If the winner is under the age of 18 years, the prize will be awarded to the winner’s parent or legal guardian on behalf of the winner.  It is the responsibility of the winner’s parent/legal guardian to prove their parental status/ legal guardianship at the time of winner notification. In the event that for any reason whatsoever a person/s mistakenly represents themselves to be a winners parent and/or legal guardian, then that person will be liable for all costs associated with relocating and/or re-awarding the prize (including but not limited to and administrative fees incurred by the Promoter). Where relevant, the Promoter is only responsible for ensuring that the prize is awarded to a person who is either a parent or legal guardian of the winner. The Promoter is not responsible for determining any other delivery details or taking direction that relates to any ongoing family law negotiations and/or determinations. These are the responsibility of the winner and their respective parent/s and/or legal guardian/s.
  11. The prize will be delivered to the nominated address of the Prize winner. Delivery of the Prize is valid to any state and/or city in Australia.
  12. In the event that for any reason whatsoever the Winner does not take the prize at the time stipulated by the Promoter, then the prize will be forfeited by the Winner and cash will not be awarded in lieu of the prize.
  13. In the event that a prize, or part of a prize, is unavailable, the Promoter reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal recommended retail value and/or specification subject to any written directions from the various Lottery Departments.
  14. The promoter is neither responsible nor liable for any late lost or misdirected mail (including but not limited to prizes).
  15. The Promoter is not responsible nor liable for any prize damaged in transit in the delivery of their prize
  16. A draw for any unclaimed prizes may take place on 30 January 2015 at the same time and place as the original draw, subject to any directions from a regulatory authority.  Winners, if any, will be notified in writing using the contact details in their membership within two (2) business days of the unclaimed prize draw and will be published in Take 5 issue 10, on sale 26 February 2015.
  17. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
  18. In the event of unforeseen circumstances, war, terrorism, state of emergency or disaster (including  but not limited to natural disaster)the  Promoter reserves the right to subject to reference to all relevant  state and territory rules and regulations, to cancel, terminate, modify or suspend the promotion.
  19. If a medical circumstance in some way restricts your ability to enter the competition through the required mechanic, you are still eligible to enter however you must briefly state your circumstances upon entry.
  20. If your entry is selected as a winning entry, validation of your circumstances/ the validity of your entry will be undertaken by the Promoter. Method of validation (without limitation) will be determined by the Promoter in its complete discretion. If the winning entry is deemed to be a winner, the winner will be notified as per the terms and conditions herein. In the event that the Promoter requests the entrant to sign any legal documents relating to the verification of their medical circumstance, the legal documents will take the form determined by the Promoter. It is a condition of accepting the prize the winner sign any such legal documentation.
  21. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  22. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees,  the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.
  23. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

  1. Take 5 Family Feud Promotion Terms and Conditions

  1. Information on how to enter and prizes form part of these terms and conditions. Participation in this promotion is deemed acceptance of these terms and conditions.
  2. Entry is open to Australian residents aged 18 years or over only who purchase Take 5 during the promotional period. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter.
  3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these terms and conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter’s discretion.  Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. Incomplete, indecipherable or illegible entries will be deemed invalid.
  4. Only one Take 5 Family Feud game card permitted per specified purchase requirement. Each instant win prize claim must be submitted separately and in accordance with entry requirements.
  5. Promotion commences 28/8/14 and all claims for prizes and entries must be received by last mail on 26/9/14.
  6. To enter, consumers must purchase Take 5 Issues 36 or 37 (on sale 28/8/14 and 4/9/14 respectively) to receive their free Take 5 Family Feud game card. The game card from Take 5 Issue 36 is valid for play each day from 1/9/14 to 5/9/14 inclusive. The game card from Take 5 Issue 37 is valid for play each day from 8/9/14 to 12/9/14 inclusive. Consumers have the chance to win each day during these periods. Consumers are to watch Family Feud on Network Ten in Australia each weeknight from 1/9/14 to 12/9/14 inclusive. Each weeknight the show will air a special Take 5 Question of the Day segment. When prompted during the segment, consumers are to scratch the panel printed on their game card corresponding to that particular weeknight to reveal their answer. If the answer printed on their game card for that particular night matches the answer revealed during the Take 5 Question of the Day segment, they have won the major prize. There is also a bonus question on the Take 5 Family Feud card where consumers don’t have to watch Family Feud. The question is what is the surname of Family Feud’s host Grant? Consumers must scratch the bonus question panel, and if they reveal the correct answer of ‘Denyer’, they have won $1,000.
  7. To claim their prize, consumers fill in the coupon printed inside their Take 5 and send it to Take 5 Family Feud PO Box 401, Eastern Suburbs MC NSW 2004. If Family Feud is not broadcast in the local area, consumers will be entitled to enter the promotion by filling in the coupon printed inside their Take 5 Family Feud game card and sending it to the address published inside the game card, along with the game card itself. The Promoter will check if the game card is a winner. If the entrant is not a winner they will be entered into the unclaimed prize draw. Consumers with a noon-winning game card are also entitled to enter the unclaimed prize draw by simply completing the coupon and sending it in as per the above. Claims and unclaimed prize draw entries must be received by last mail on 26/9/14 and are subject to verification. Consumers are advised to make and keep a clear photocopy of both sides of their winning game card for their records. Winners, if any, will be notified by mail and published in Take 5 Issue 44, on sale 23/10/14.
  8. Major Prize: Ten (10) x $5,000 awarded in the form of a cheque made out to the winner/s. Minor Prize (Bonus): One (1) x $1,000 awarded in the form of a cheque made out to the winner.Overall total prize pool is valued at $51,000.
  9. A draw for any unclaimed prizes may take place at National Products Fulfilment Pty Ltd, 6 Ross Place, Wetherill Park, NSW 2164 on 9/1/15 at 11am AEDST, subject to any directions from a regulatory authority. Winners’ names will be published in Take 5 issue 7 on 5/2/15.
  10. Any change in the value of the prize between publishing date and the date prize is claimed is not the responsibility of the Promoter.
  11. Ineligible, illegible or incomplete claims and entries received will be considered null and void. Instant win game materials are rendered void if stolen, forged, mutilated, incomplete or tampered with in any way. Photocopied or faxed claims and entries will not be accepted.

Take 5 Club Puzzle Issues 35-9, 2014/2015 Terms and Conditions

  1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in the promotion is deemed acceptance of these Terms and Conditions.
  2. The promotion is only open to Australian residents who are members of the Take 5 Club only. Employees of the Promoter, their immediate families, authorised outlets and agencies associated with this promotion are ineligible to enter.
  3. To enter, entrants must complete the puzzle located on the Take 5 Club page in the corresponding issue of Take 5 magazine as per Table A and visit the club site at www.take5mag.com.au and sign in to submit their answer. 6. The Promoter’s decision is final and no correspondence will be entered into. 7. Only one (1) entry permitted per Take 5 Club member per draw period. Winners may be asked to present their Take 5 Club membership card and identification at the prize delivery address in order to receive their prize. 8. The first (insert number) valid entry/entries drawn in each individual draw period  will each win: [insert prize details] valued at up to $[insert value] (prizes may include movie tickets, vouchers, cash, ipads, gift cards etc) The total prize pool for each individual draw period is valued at up to $1000 (including GST).   1. Bidding is open to all residents of Australia except employees and their immediate families of the Promoter and its agencies associated with the Take 5 Reverse Auction.
  2. By entering any bid in the Take 5 Reverse Auction, bidders confirm they have read and understood these Terms and Conditions and are deemed to have accepted them.
  3. The Take 5 Reverse Auction is open each Thursday at 12:01am ADST/AEST from 19/06/14 to 18/12/14 and ends each Wednesday at 11:59pm ADST/AEST from 25/6/14 to 24/12//14.
  4. To place a bid for the item(s) as printed on the Reverse Auction page in Take 5, consumers SMS the word BID and their bid in whole cents to the SMS number printed on the page during the relevant bidding period. All bids are to be in Australian cents and include GST. Cost of each SMS message sent is $0.55 including GST.
  5. All bids must be sent by SMS. SMS via the internet not accepted. Bids are deemed to be received at the time of receipt into the Reverse Auction database and NOT at the time of transmission by the bidder.
  6. All bids must be submitted by an individual and must not be computer generated. The use of any automated software or any other mechanical or electronic means that allows a bidder to automatically bid repeatedly is prohibited and will render all bids submitted by that bidder invalid.
  7. The SMS entry mechanic is only open to consumers with an SMS compatible mobile phone connected to a service provider which permits text messaging to premium SMS numbers. Premium SMS service provider is Salmat Digital Pty Ltd.  SMS helpline: 1300131276
  8. Once a bid has been submitted, consumers will receive a reply SMS message, notifying them that (a) their bid is currently the lowest unique bid; or (b) their bid is currently unique but not the lowest bid; or (c) their bid is not unique; or (d) their bid is invalid. SMS messages will be sent throughout the course of the bidding if the bid changes from one of these categories to another.
  9. All bids are processed in the order that they are received into the database. No responsibility accepted for any late, lost, incomplete, incomprehensible, incorrect, delayed or misdirected bids as a result of technical disruptions or for any other reason.
  10. The Promoter reserves the right to verify the validity of bids and to disqualify any bidder who tampers with the bid process or who places a bid that is not in accordance with these Terms and Conditions. Successful bidder must provide proof of identity, proof of residency and proof of relevant mobile bill before item will be dispatched. Pre-paid mobile users will be required to provide proof of purchase of all pre-paid recharge cards. Acceptance of alternate identification as verification is at the complete discretion of the Promoter.
  11. A new item(s) will be offered for bidding each week during the Take 5 Reverse Auction. The consumer who has placed the lowest unique bid that week will be deemed the successful bidder for the lot on offer for that week just ended. The lowest unique bid is the lowest value offered (in whole cents) for the lot, which has not been offered by any other bidder for that lot. If there is no lowest unique bid, the successful bidder is determined by the lowest bid amount with exactly two bids. The first bidder to have placed the bid is determined the winner. If this does not produce a winner (if there is no low unique bid with exactly two bids the same) the process keeps repeating for the highest bid amount with exactly three bids. This will continue until a successful bidder is determined.
  12. By placing a bid during the bidding period, consumers are offering to buy the relevant lot at that price as accepted by the Promoter. Ownership and title in the item does not pass to the successful bidder until the Promoter receives full and clear payment, and risk in the item passes to the successful bidder when the Promoter dispatches the item to the successful bidder.
  13. The successful bidder of a lot will be notified at the end of the bidding period by phone, to arrange payment for the lot. If the successful bidder does not contact the Promoter to pay for the lot within 14 business days of first contact, then the bid is forfeited and the next lowest unique bidder will be contacted.
  14. The successful bidder will be required to pay for the lot, at the price (being the successful bid rounded up to the nearest whole legal tender cent) placed by the person, within 14 business days of being notified of the bid’s success. Payment will be accepted by Bankcard, Mastercard, Visa, Diners, Amex, cheque or money order. If payment is not received within 14 business days, the bidder will be deemed to have revoked the offer and will no longer be able to purchase the lot.
  15. The lot will be delivered within 21 working days after payment is received to the address provided by the successful bidder.
  16. If the lot (or any part of the lot) is unavailable, the Promoter, in its discretion, reserves the right to substitute the lot (or that part of the lot) with an item(s) to the equal value and/or specification.
  17. The Promoter reserves the right in their absolute discretion to cancel, withdraw, reject, suspend or bar a bidder and their bid at any stage during the bidding period.
  18. The Promoter’s decision in relation to all aspects of the Take 5 Reverse Auction is final and no correspondence will be entered into.

If for any reason the Take 5 Reverse Auction is not capable of running as planned due to any reason (including but not limited to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes), including anything which may corrupt the integrity or proper conduct of the Take 5 Reverse Auction, the Promoter reserves the right to cancel, terminate, modify or suspend the auction.
  20.
